Haji Ali Dargah Case: Women Entry Allowed - Mumbai High Court

On the most controversial decision/case, Mumbai High Court has pronounced the verdict on the women entry in the Haji Ali Dargah/mosque. Upon the Public Petition of Noorjehan Niaz and Zakia Soman(members of Bharatiya Muslim Mahila Andolan (BMMA)), Mumbai high court has said that under section 14,15 and 25 of Indian constitution, we hold the ban of haji ali dargah on women entry to mazzar (nearest place) by Haji ali dargah trust.

Why was the Ban Imposed in Haji Ali?

Till 2011, women entry were allowed in the dargah, but after few complaints of eve teasing, dargah trust has banned the women entry in the haji ali. While in the court, Haji Ali dargah has given written reply that...;

“Safety and security of women. The trust members further, under the guise of ensuring safety of women from sexual harassment, cited complaints they had received from women, of belongings being stolen and of eve-teasing, and hence rationalized the ban”.

Not only that, Haji ali board has also stated that as per the Shariat law (Islamic law) Women are not allowed in the mosque. Haji ali is dargah cum mosque, which was built in 1431 on the memory of Sayyed Peer Haji Ali Shah Bukhari. Haji ali dargah is situated in worli Mumbai, between the Arabian sea.

Petitionar and trupti desai (women right activist) has thanked the court and said it is historical decision by court and they will keep the women right fight on going. While the haji ali dargah tutees are going to Supreme court to challenge the high court verdict on Haji ali women entry ban.

It is also need to clarify that as per islam, no women are allowed to offer prayer in mosque. Not only haji ali, all the mosque of india does not allow women entry as per sharia law. While in india, as per the Indian constitution, men and women has given equal rights.

Court has also ordered Maharashtra government to provide security in haji ali and easy access to women’s in haji ali. Justices V M Kanade and Revati Mohite Dere bench also said trust to give proper security to women in haji ali.

Trupti desai and her fellow women activist had earlier protested on the ban of women entry at shani mandir, mahalaxmi mandir Mumbai and many more.

Now they are going to fight to get women entry in Sabarimala temple, Trimbakeshwar temple, Nashik, Kartikeya temple, Pushkar and Sree Padmanabhaswamy Temple, Thiruvananthapuram. Above mentioned temples and all the mosques of india does not allow women entry in temple.
